These Terms of Use (the "Terms") define the rights and obligations of all users ("you") when using the binam.io website and related services owned by Binam (the "Company", "we", "us").
By using any of the services on our platform, you confirm that you have read and agree to these Terms. If you do not agree with them, please stop using our services.

1. Our platform
1.1. Binam services
1.1.1. We provide a platform and tools for assessing trading skills in cryptocurrency futures markets. Traders are given the opportunity to complete an evaluation program (Challenge) while working with demo accounts in real market conditions.
1.1.2. Before you can start trading for real profits, you must complete one of our evaluation programs (Challenge) and successfully pass it.
1.1.3. At each stage, you are provided with support from our team, access to the terminal, and risk management tools.
1.1.4. Successfully completing all evaluation stages gives you the opportunity to receive a funded account on which you can trade and earn up to 90% of the profits.
1.1.5. You acknowledge that any operations carried out within the Challenge are demo account trading and are not related to real trading assets.
1.1.6. By using our services, you agree to the established trading and evaluation rules outlined in the “Offer Rules” document.
1.2. Third-party services
1.2.1. You acknowledge and agree that Binam may provide access to third-party services, including cryptocurrency exchanges (Bybit, Binance, and others).
1.2.2. You may connect your account to third-party platforms if that option is available. By connecting your account to a third-party service, you consent to the transfer of certain information to those third parties within the privacy settings. If you do not want your data to be transferred, do not use this feature.
1.3. Changes to the Terms
1.3.1. Binam reserves the right to make changes to these Terms at any time.
1.3.2. You are responsible for reviewing updates in a timely manner.
1.3.3. If you continue to use the Binam platform after changes are made, it means you agree to the new terms.
1.3.4. If you do not agree to the amended terms, you must immediately stop using the platform and its services.
1.4. Privacy
Your use of binam.io is governed by our Privacy Policy. Please review it — it explains how we collect, store, and process your data.
1.5. Electronic communication
By visiting binam.io or sending us emails, you interact with us electronically. You agree to receive electronic notices from us, including agreements, notifications, disclosures, and other communications that satisfy all legal requirements for written documents.

2. Availability
You understand and acknowledge that the Binam platform may be temporarily unavailable due to the following reasons:
- technical equipment failures;
- scheduled maintenance or system updates;
- force majeure circumstances or events beyond the Company’s control.
The Company is not responsible for temporary unavailability of the platform.

3. Account management
3.1. Account registration
3.1.1. When you purchase one of our plan packages, you will receive login credentials for the Binam platform.
3.1.2. You are not allowed to share your password with third parties, except authorized Binam employees.
3.1.3. You must provide only current, accurate, and complete information and update it promptly. Providing false data will lead to your account being cancelled or rejected.
3.1.4. Any actions performed on the platform through your account will be considered performed by you.
3.1.5. As part of our service, you will receive a demo account intended for participation in the evaluation program and the Challenge.
3.1.6. Binam has the right to rely on contact information and other data you provide when registering your account.
3.1.7. Your account may not be transferred or reissued to third parties.
3.1.8. You may delete your account at any time.
3.1.9. Binam is not responsible for unauthorized access to your account by third parties resulting from theft, hacking, or misuse of your data.
3.1.10. We reserve the right to refuse to provide services, cancel accounts, delete or edit content without explanation, and with immediate effect.
3.1.11. To receive payouts after successfully completing the Challenge, the trader must undergo identity verification (KYC).
3.2. Account setup
3.2.1. After completing registration, you can configure your account to participate in the evaluation process in a “1-step” or “2-step” format.
3.2.2. After placing an order and payment, login data will be sent to you within a few minutes up to 48 hours.
3.2.3. It is strictly forbidden to give or receive services from third parties, including account boosting, renting accounts, or selling access in exchange for profit. Violation of this rule will result in the blocking of all active participant accounts.

4. Age restrictions
Use of the Binam platform is allowed only for persons who have reached the age of majority in their jurisdiction (typically 18 years or older). If you are under 18, use of the platform is prohibited.

5. Plans and payments
5.1. Participation fee
5.1.1. To participate in the Binam evaluation process, you must pay a one-time fee that depends on the chosen format and account size. This payment grants access to the evaluation process but does not guarantee a funded account, financial reward, or refund if you do not pass.
5.1.2. Binam does not provide refunds for the Challenge, regardless of your results or progress. The only exception is the additional “Refund upon successful completion” option, the terms of which are described in the “Offer Rules” document.
5.2. Demo funds
5.2.1. All funds provided during the Challenge stages are virtual (demo funds). They are not real money and cannot be used for trading in the real market.
5.2.2. Any profit earned during the Challenge stages is virtual, non-withdrawable, and not real income. It serves solely to evaluate trading performance.
5.2.3. At the funded account stage, profit can be converted into real payouts in accordance with the terms described in the “Offer Rules” document.
5.3. Payment currency
5.3.1. Participation fees are accepted in cryptocurrency (USDT and other supported cryptocurrencies).
5.3.2. Binam is not responsible for possible cryptocurrency exchange rate fluctuations or additional network fees.
5.4. Participation cost
Current plans are listed in the “Offer Rules” document and on the pricing page in your personal account. The cost includes access to the evaluation process, risk management tools, and access to trading platforms.

6. Trading data
6.1. Binam has access to information about all trades on demo accounts and may share this data with partners, liquidity providers, and other affiliated companies.
6.2. The trader has no right to financial compensation for the use of their trading data. This data may be processed and used by the Company without prior notice.
6.3. The Company may change trading conditions without notice, including liquidity providers, quotes, and platforms.
6.4. Spreads and slippage depend solely on the liquidity provider. The Company does not add artificial fees, spreads, or slippage.

7. Funded trader
If the trader successfully completes the evaluation program, they must undergo identity verification (KYC) and, if required, sign an individual agreement with Binam.

8. Ownership of information
8.1. You retain all rights to the information you provide on the platform.
8.2. You grant Binam permission to use content related to your results for promotional purposes of the platform.
8.3. The Company does not sell your personal data to third parties.

9. Term
The rights and obligations under these Terms are valid while the user's account remains active.

10. Dispute resolution
10.1. The parties must seek to resolve disputes amicably.
10.2. If amicable resolution is not possible, disputes are handled in accordance with UAE law and in UAE courts.

11. Limitation of liability
11.1. You use the platform at your own risk. Binam is not liable for losses caused by force majeure circumstances beyond the Company’s control.
11.2. Binam and its partners may make changes to the platform at any time, including moving user accounts between platforms if necessary.
11.3. Neither Binam nor its employees, agents, partners, and affiliates are liable for indirect, incidental, or special damages related to the use of the platform. If you are not satisfied with the platform or services, your only remedy is to stop using them.
11.4. This limitation applies to the maximum extent permitted by law.
11.5. You agree to indemnify Binam, its employees and partners for losses resulting from your use of the platform, violation of the Terms, or the rights of third parties.

12. Disclaimer
12.1. Binam provides services for evaluating trading skills and does not provide financial, tax, or brokerage advice.
12.2. Binam does not accept deposits. Fees are charged solely for participation in the evaluation program and to cover operational costs.
12.3. Binam is not a broker and does not provide brokerage services.
12.4. Binam is not a custodian and does not provide custodial services.
12.5. Past results are not a guarantee of future results.

13. Intellectual property
13.1. All services and platform content belong to Binam and its licensors.
13.2. Binam trademarks may not be used without the Company's written consent.
13.3. All transactional data belongs to the Company and is governed by the Privacy Policy.

14. Governing law
14.1. Binam is managed from the UAE, and this Agreement is governed by the laws of the UAE.
14.2. If you use the platform outside the UAE, you must comply with applicable local laws.

15. Termination
15.1. Binam may terminate your access to the platform at any time without prior notice. In this case, a refund for an active Challenge payment may be considered.
15.2. After termination, certain obligations remain in force, including liability and indemnification provisions.

16. Entire agreement
These Terms of Use, the Offer Rules, and the Privacy Policy constitute the entire agreement between the parties and supersede all prior arrangements.
